You have been divided into groups of 3-5 students in order to complete this project. It is recommended that each member of the group analyze one of the elements of malpractice and divide the remaining three questions however you prefer.
Your group will create a page or pages in Canvas in APA format that will incorporate many areas of law and synthesize knowledge from your Chapter 8 of our text book. This project does not require a title page. It is anticipated that you will need some resources to define your terms and support your opinions. Plan to use APA formatting for citations and a reference list. You may place your reference at the end of each section or make one reference list for the whole project. Once you have completed your page(s), one of your group will submit the link for grading. You can collaborate for the majority of the assignment in any manner you choose for your group. You will need to have at least TWO entries in the group discussion assignment to help validate your participation in the work.
Each member of the group should take responsibility for an equal portion of this assignment and also review the other members’ work for accuracy and completeness. You must indicate in the submitted work what information you are responsible for. Each section of the 4 main areas should have at least 150 words. This means your paper will have at least 600 words of content.
Case Study:
Our patient Mr. Ramirez is 72 years old and is currently hospitalized. His medical history includes prostate cancer with metastasis to the bone. His burden of symptoms include pain from the tumor and side effects of his pain medication. Sometimes these effects from the medications can make him lethargic and groggy. Our patient Mr. Ramirez has a desire to get up and move about his room taking short walks. Also, in Mr. Ramirez ‘s history is a partial paralysis of his left leg after a low back injury. All these factors have given Mr. Ramirez a fall risk score.
Due to his fall risk the patient was placed across from the nurse’s station. His bed was placed in a low position, he was given instructions on how to use his call light. Despite all this staff have found Mr. Ramirez trying to get out of his bed without help on a regular basis. During his hospital stay he had a fall with no injuries. He was counseled that he should not leave his bed unless somebody else was present. Interventions included leaving a light on in the room and moving the furniture in his room to increase observation by the nurses.
Mr. Ramirez continues to voice his objections stating that he is an adult and can make his own choices. The family does get involved and they share that our patient had an experience where he had been trapped in a burning building and was afraid of enclosed spaces.
Knowing that patients who have fallen in the last six months have an extremely high likelihood of falling again in the near future, if Mr. Ramirez falls again in the hospital, is the nurse responsible? Mr. Ramirez does fall again. He sustains some skin tears and minor bruising. His family it’s very upset that the patient keeps falling and the nurses know that he is such a high risk.
Which type of law is malpractice? Define and explain your answer.
Does the family have legal grounds for a malpractice suit? Analyze the four elements of malpractice and apply the case study to them to determine whether or not malpractice has occurred:
Did the nurse have a duty to the patient?
Was there a breach of that duty, if so specifically what duty was breached?
Did injury, harm or damage occur to the patient?
Did the harm or damage that was caused result from the breach of duty?
Can the nurse be charged for criminal malpractice, why or why not?
Define / cite and apply one of the intentional torts to the case study and state whether or not the nurse could be sued for violating that intentional tort.
